By virtue of an Order of Sale No. CV2025 03 0976 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, KANDY FATHEREE, Sheriff of said County, will offer for sale at Public Auction, ONLINE, in accordance with ORC Section 2329.153 at https://summit.sheriffsaleauction.ohio.gov on

at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of New Franklin, County of Summit and State of Ohio:

PARCEL I:

And known as being a part of Fractional Section Number 2 of said township and bounded and described as follows:

Beginning at a point on the center line of the Barberton-Alliance Road, (S.H. 850) to said point is also the Southwest corner of Fractional Section No. 2 of Franklin Township; thence S. 83 deg. 54' E., along the center line of the Barberton-Alliance Road, a distance of 113 feet to a point; thence N. 6 deg. 15' E., along the center line of Tomsik Drive, now dedicated as Township Road #470, a distance of 555 feet to a point and the true place of beginning; thence continuing N. 6 deg. 15' E., along the center line of roadway, a distance of 105 feet to a point; thence S. 83 deg. 54' E., 225 feet to an iron stake; thence S. 6 deg. 15' W., a distance of 105 feet to an iron stake; thence N. 83 deg. 54' W., a distance of 225 feet to a point on the center line of Tomsik Drive and the true place of beginning. A parallel strip of land, 25 feet in width is reserved from the entire West side of the above described parcel, the same being a part of the East half of a private 50 foot roadway to be known as Tomsik Drive. The above described parcel being known also as Lot No. 12 in Tomsik Park Hills Allotment, unrecorded.

Beginning at a point on the center line of Turkeyfoot Lake Road, S.H. 619.60 feet wide, said point is also the Southwest corner of Fractional Section No. 2 of said Franklin Township; thence S. 83 deg. 54' 00" E., along the center line of Turkeyfoot Lake Road, a distance of 184.3 feet to a point; thence N. 06 deg. 15' 00" E., along the center line of Hilltop Drive, T.R. 470, 50 feet wide a distance of 501.75 feet to a point and the true place of beginning of land herein to be described; thence N. 06 deg. 15' 00" E., along the center line of Hilltop Drive a distance of 52.45 feet to a point and the Southwest corner of land conveyed to D. D. & M. M. Hofmann, by instrument recorded in D.B. Vol. 4006, Pg. 399; thence S. 83 deg. 53' 37" E., along Hofmann's South line passing over a 5/8" rebar with I.D. Cap #6541 set flush at 25.00 feet a total distance of 224.69 feet to an old rusty 1/2" pipe found 1" high on the West line of land conveyed to D. & P. A. Wagner by instrument recorded in D. B. Vol. 5899, Pg. 3; thence S. 06 deg. 13' 47" W., along Wagner's West line, a distance of 52.52 feet to a 5/8" rebar with I.D. Cap #6541 set flush; thence N. 83 deg. 52' 37" W. through the Grantor's land passing over a 5/8" rebar with I.D. Cap #6541 set flush at 199.71 feet, a total distance of 224.71 feet to the place of beginning and containing 0.2708 acres or 11.794 sq. feet of land, be the same more or less, but subject to all legal highways, rights and easements of record, as surveyed in January, 1987, by John W. Patrick, Jr., Professional Land Surveyor No. 6541. The bearing of N. 06 deg. 15' 00" E., along the center line of Hilltop Drive, as described in D. B. Vol. 7041, Page 167, was used as the "Basis of Bearings" for the survey and legal description.

Property appraised at: One Hundred Eighty Thousand Dollars ($180,000.00).

The appraisal was completed based on an exterior view of the property only.

Property cannot be sold for less than 2/3 of the appraised value.

TERMS OF SALE: $5,000.00 Deposit must be on account with Realauction (See online bidding instructions). The entire balance of the purchase price shall be paid by cash or cashier's check ONLY within thirty (30) days after the filing of the Confirmation Entry, to the Summit County Sheriff.

If this sale remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m., ONLINE at

on the 20th day of March, 2026. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v))

The purchaser shall pay the actual costs (conveyance and recording) to the Sheriff for the recording of the deed. (ORC 2329.36(C)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))

The Sheriff's Office nor any of its affiliates have access to the inside of said property, at any time. (This includes appraisals for bank loans.)
